Power of Attorney & Guardianships

An Enduring Power of Attorney allows someone to act on your behalf if you become mentally incapacitated and can do the following;

  • Deal with Centrelink and Medicare
  • Sign documents to claim on your life insurance policies
  • Access your bank accounts
  • Manage your superannuation and investments to ensure your financial wellbeing is taken care of
  • Can deal with anything that involves business, property and money.

We encourage our clients to have in place an Enduring Power of Attorney. This can be useful where documents need to be signed and one party is absent. It can be vital in the case of long term illness or mental disorder.



Powers of Guardianship
may appoint someone to authorise your health, care and medical related decisions for you if you are unable to do so yourself.





The person/s you appoint may do the following;

  • Approve care and management plans
  • Decide which doctor or dentist to use and what treatments can be carried out
  • Consent to entry into a nursing home or hostel
  • Authorise recreational activities, holidays, day programs and visitors

A Medical Power of Attorney is another document and is limited to the authority to consent or refuse medical treatments. Usually you do not need a Medical Power of Attorney if you have a Power of Guardianship.
